I am referring to this misogynist judge’s ruling as reported in the Kansas City Star. This is so wrong on any and every level, it is hard to know where to begin.

Is this a case of, “He said, She said?”

If “He” says that it was consensual, what is she supposed to do? Demurely say, “No, it wasn’t.”

My ems.

But Bowen [the rape victim] says there is nothing fair about allowing the defense to describe what happened as sex and forcing the victim to describe it in the same words, especially when jurors are not told that an order limiting speech is in place.

A little history

The jury in Bowen’s case deadlocked after one trial in 2006. The judge declared a mistrial because of pretrial publicity before a second trial in 2007.

Prosecutors dismissed the case before a third trial because of the judge’s orders on what words could be used and limits on evidence, including prior rape allegations against the defendant.

It would have come down to his word against hers, and as Bowen said, “The judge took my words away from me.”

The trial judge, as is normally the case, did not give any explanation as to why he banned the word “rape” and the term “sexual assault.” Anothe circuit judge commented,

The issue is a discretionary call with judges, said Jackson County Circuit Judge Brian C. Wimes, who did not preside over Slaughter’s trial. Wimes said he typically would not grant a pretrial order limiting certain words, but he would verbally tell the attorneys to avoid using words in a prejudicial or inflammatory way. “You don’t want to create an unfair environment,” he said.

Which as far as I am concerned is pure bull shit.

First off, most rapes/sexual assaults/violations of a woman’s person go unreported. The vast majority go unreported.

Of those that are reported, not many go to trial because it is a “he said, she said” situation, evidence is tainted or compromised or she waits too long to report the crime.

Now, I ask anyone with a half an ounce of brains, why would a women put herself through all the humiliation, embarrassment and have her character dragged through the mud, if she was not telling the truth.

Okay, I’ll admit there is the “woman scorned” aspect. And maybe, it is possible that one out of, oh, say a thousand cases of rape turns out to be be a case of payback to a guy that was innocent. Just because that may be possible, do we let 999 women go with out justice.

I hope not.
